Evicting a tenant or resolving a complaint can be a multi-stepped, complicated process – something most landlords don’t appreciate until they’ve overstepped the law and violated their tenants’ rights. It’s also important to remember that while your case is under consideration, you’re still responsible for making rent payments. Even if your dispute concerns habitability issues such as lack of heat, or rodent/roach infestation, you are still required to pay rent. The court requires that all outstanding rent be deposit with the Court pending resolution at trial. In such cases, an inspector will inspect your apartment and will report back to the Court, which will determine what amount of rent, if any, you are entitled to as a refund.
