A 29-year old first-time driver operating a rental vehicle was struck when the defendant failed to stop at a red light. Client suffered a cervical disc herniation and three lumbar disc bulges. This case was a two-fold challenge, as we not only had to fight to obtain compensation for our client from the negligent party; we had to deal with the rental car's insurance company when they refused to pay for our client's medical treatment.
We successfully had the rental company's insurance carrier pay for our client's medical treatment and settled the case against the negligent driver after depositions were held. After initially denying the claim, the defendant's insurance company quickly settled when their insured admitted during depositions that he confused the gas pedal with the brake pedal, despite initially denying that he was at fault.
