East Brunswick, NJ - Our client was driving down Route 18 South in the right hand lane approaching the intersection of Ruth Street, when the defendant, who was in the center lane of 18 South, attempted to change lanes from the center lane to the right lane and failed to observe our client’s vehicle causing her vehicle to collide with our client’s vehicle, running our client off the road. Our client sustained injuries to her neck, back and right knee. Due to the severity of injury to her right knee, our client required surgical intervention to repair the damage. The defendant was not properly insured, carrying only a policy for the state minimum of $15,000. Our office filed a claim for underinsured motorist benefits with our client’s own insurance carrier. Since our office was not able to resolve the claim with either insurance carrier, our office instituted suit against the defendant and for underinsured motorist benefits. Shortly after we filed the lawsuit, our client’s insurance carrier agreed to settle the claim for the policy limits of her underinsured motorist coverage.
