Newark, NJ - In December 2012, our client was traveling on 78W near the Garden State Parkway exit. The defendant was exiting the Garden State Parkway to head west on 78 when he lost control of his vehicle and wound up traveling eastbound down the westbound lanes of I-78. The defendant’s vehicle collided head on with our client’s vehicle. Sadly, the defendant perished in the crash. Following the accident, our client was admitted to the hospital with mutliple injuries to the hands, spine, in addition to a traumatic brain injury. The defendant’s insurance carrier refused to settle so our office filed suit. The defendant’s attorney filed an answer and our office filed a motion for frivolous litigation stating that none of the defenses cited in the defendant’s answer could be proven because he was deceased. Three days before the return date of the motion, the defendant’s insurance carrier offered their policy limits to settle.
