Accident with a cell phone? What are the penalties?

On July 18, 2012,  New Jersey has passeda law allowing full prosecution of cell phone users if they drive recklessly and cause serious harm or death. Penalties would include prison time and fines up to $150,000, similar to drunken driver punishments.

Handheld cell phone users causing serious crashes will be prosecuted under criminal homicide or assault-by-vehicle laws. If you were involved in an accident, and suspect that the other driver was using a mobile phone, immediately make the investigating police aware of this.
