A: In most cases the defendant will be insured by an insurance company. If the defendant is insured by an insurance company it is usually the obligation of that insurance company to not only pay any judgment against the defendant but also to pay for the defense of that defendant in this case. If the defendant is uninsured collecting a personal injury Award becomes a little bit more tricky. If the defendant is what is called judgment proof i.e. has no assets, no job, or no income to which to attach a judgment then the chances of collecting an Award personal injury or otherwise is very slim. Additionally if that person is eligible for bankruptcy and basically has nothing to lose by filing bankruptcy in most cases that person will be able to discharge the judgment against him or her in bankruptcy proceedings.
