I walked into the street without looking and got hit. Can I still sue the driver?

NJ is a 50% comparative negligence state, which means that one party has to be more than 50% negligent in order to be able to sue.  If you crossed the street without looking, it is more likely than not that you would be more than 50% negligent and therefore you would be unable to sue.
