I was involved in a car accident in a different state but I am insured in the State of New Jersey. Do I file a claim in New Jersey?

 

A: If you're involved in a car accident outside of the State of New Jersey your New Jersey automobile insurance policy will cover you for medical expenses and will cover the cost to repair your car if you have collision coverage. As far as filing a complaint against the other driver in most instances you will need to file the complaint in the state where your auto accident took place unless filing that complaint would cause you undue hardship. For example if you live in New Jersey and you are involved in a car accident in California you may be able to file a claim in the federal court for the State of New Jersey.
