A: You should never move your car from the location of the accident until the police arrive unless your car is a hazard to other drivers or is blocking a one lane road. However, having said that, never ever move your car's debris from its location at the road, until the police come to document the accident. AND....I would strongly suggest you take some photos of the accident location showing how the cars have come to rest after the accident. You can take pictures with your cell phone or with a disposable camera. Click this link to "Like Us" on Facebook® and we will send you an accident toolkit with a disposable camera to keep in your car at all times, just in case you are involved in an accident.
One of my clients was involved in an accident, and it was completely the other driver's fault and my client had the right of way. Because the debris was moved, the other driver is now claiming that my client is at fault (or at least 50% at fault) and he is relying on pictures he took of the debris. Of course, he denies moving any debris from the road, and now the insurance company is giving my client the runaround.
Lesson be learned. Don't move the debris after an accident!
